1. Agreement

By using this website, the AI Visibility Check, the AI Opportunity Calculator or the contact form, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.

2. Informational service

The site and its free diagnostics are provided for general business information. The AI Visibility Readiness Score is our own diagnostic methodology, not a score from any search or AI platform. Calculator outputs are directional estimates based on the inputs and labelled assumptions you provide. Nothing on this site is legal, financial, tax or other professional advice, and nothing here creates a client relationship; a consulting engagement begins only under a separate written agreement.

3. No guarantee of results

AI-generated answers vary by platform, model, query wording, time, location and personalization. We do not guarantee that any business will appear, rank or be recommended in any AI or search system, nor do we guarantee revenue, savings, rankings, legal compliance or any particular business outcome. Capacity value is not the same as cash savings, and revenue opportunity is not a forecast.

4. Acceptable use

You agree to use the site and tools only for lawful purposes and for a business you own or are authorized to represent. You agree not to:

• submit websites you are not entitled to have analyzed, or use the scanner to probe systems;
• enter customer, patient, employee or financial-account data, passwords or other sensitive information;
• circumvent rate limits, bot protections or access controls, or automate submissions;
• copy, scrape or resell the tools, reports or methodology;
• interfere with the operation or security of the site.

We may suspend access for misuse.

5. Your results and content

Your results are delivered at a private link. You are responsible for who you share that link with. You retain your own business information; you grant us permission to process it to provide the service and, in aggregated or anonymized form, to improve our methodology and research.

6. Intellectual property

The site, its content, the scoring rubric, the opportunity model, report formats and branding are owned by NUDGE or its licensors and are protected by applicable intellectual-property laws. You may use your own results for your business; you may not reproduce or redistribute the site content or methodology without permission.

7. Third-party services

The site relies on third-party providers, including hosting, database, email, analytics, scheduling and, when enabled, AI and search providers. Their availability and terms are outside our control. Links to external sites, including official platform documentation, are provided for reference; we are not responsible for their content.

8. Availability

The site and tools are provided “as is” and “as available.” We may change, suspend or discontinue any part of them at any time. Scans may be unable to complete for some websites; where a check cannot be completed it is marked as unverified.

9. Limitation of liability

To the fullest extent permitted by law, NUDGE is not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, data or business opportunity, arising from use of or reliance on the site, the tools or their outputs. Our total liability for any claim relating to the site is limited to the amount, if any, you paid us for the specific service giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You agree to indemnify us against claims arising from your misuse of the site or from information you submit that you were not entitled to submit.

11. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

12. Changes

We may update these terms and will revise the date at the top. Continued use after a change means you accept the updated terms.
